What these terms cover

These terms govern your use of the Arkos AI, Inc. (“Arkos”) website at arkosai.com and our text-messaging program. By using the site, you agree to them.

They do not govern the Arkos services themselves. If your practice uses Arkos, the services are governed by your signed agreement with us, including a Business Associate Agreement — see our standard BAA.

Using the site

You may use the site only for lawful purposes. Don’t attempt to breach its security, probe or scan it for vulnerabilities, scrape it at disruptive volume, misrepresent your identity to us, or interfere with anyone else’s use of it.

Our content

The site and its content — text, design, graphics, logos, and software — belong to Arkos or its licensors and are protected by intellectual-property law. You may not copy, modify, or redistribute them except as the site is normally used, without our written permission.

If you send us feedback or suggestions, we may use them without obligation to you.

SMS program terms

Arkos sends text messages on behalf of the dental practices we serve — appointment communications, billing notices, and text-to-pay links — and, separately, business messages to our own prospective and current clients who have opted in.

• Opting out: reply STOP to any message to cancel at any time. You’ll receive a single confirmation message.
• Help: reply HELP for help, or contact privacy@arkosai.com.
• Frequency: message frequency varies by program and by your interactions (for example, appointment and billing activity).
• Cost: message and data rates may apply, per your mobile carrier’s plan.
• Carriers: mobile carriers are not liable for delayed or undelivered messages.

Consent to receive texts is not a condition of any purchase or of receiving care from your practice. Mobile numbers and opt-in data are never sold or shared with third parties for marketing — see our Privacy Policy.

Disclaimers

The site is provided “as is” and “as available,” without warranties of any kind, express or implied. Content on the site is general information — it is not legal, medical, or financial advice, and estimates (like our savings calculator) are illustrative, not guarantees.

Limitation of liability

To the fullest extent permitted by law, Arkos will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the site, and our total liability for any claim relating to the site will not exceed one hundred dollars (US $100). Liability for the Arkos services is addressed in each customer’s signed agreement, not here.

Governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Disputes arising from these terms or the site will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.

Changes

We may update these terms from time to time; material changes will be posted here with an updated date. Continued use of the site after changes take effect constitutes acceptance.
